1. (Scope) - These Terms and Conditions of Use govern the provision—by BIBAWO Medical A/S, a company registered in Denmark with company registration number 40931937 and registered office at Klintehøj Vænge 6, DK-3460, Birkerød, Denmark (hereinafter referred to as "BIBAWO Medical A/S”)—of certain services to users authenticated on the webshop operated by it and the protection of personal data policy associated with that service.

2. (Intellectual property) - 2.1. All materials, content and software available at the webshop, namely information, images, illustrations, graphics, names and logos, are the intellectual property of BIBAWO Medical A/S or third parties and may not be reproduced, modified, distributed, marketed, nor otherwise used, save with the express prior written consent of BIBAWO Medical A/S or of the third-party holders of the intellectual property rights to the same. 2.2. Any use of the materials, content and software available on the webshop for any purpose other than that expressly permitted by these Terms and Conditions of Use, shall be considered a violation of current national and international copyright laws.

3. (User responsibility) - 3.1. BIBAWO Medical A/S is not responsible for the accuracy of any information, image, contribution or other materials that users provide through the use of the webshop. 3.2. The User undertakes to make prudent, careful and responsible use of the webshop and to refrain from using it in a way that may imply the violation of the legally protected rights or positions of BIBAWO Medical A/S or any third party. 3.3. The User shall indemnify BIBAWO Medical A/S for any claims, penalties, fines, judgments or seizures resulting from the breach of the laws of intellectual and industrial property by same in the use of the webshop, as well as for any loss incurred on a third party, the fault or negligence of which is attributable to the User. 3.4. The User is solely responsible for any damage or loss, including loss of data, incurred on its system and/or computer equipment resulting from the use of the materials, content or software available on the webshop, unless these are proven to have been caused intentionally or through the gross negligence of BIBAWO Medical A/S. 3.5. BIBAWO Medical A/S cannot be held liable for any damage or loss that may result from (i) the operation of the User’s system and/or computer equipment; (ii) difficulties in using the webshop caused by, namely, delays, interruptions, errors, interferences or suspension of communications, viruses, bugs or malfunctions; (iii) delays caused by deficiencies or traffic overloads of the Internet or other electronic systems; (iv) illegitimate actions by a third party, errors or security weaknesses resulting from the use of outdated or unsafe equipment or browsers, failures of the electronic communications services used by the User, as well as damage, errors and inaccuracies that may result from their malfunction.

4. (Protection of personal data) - BIBAWO Medical A/S guarantees to process personal data in accordance with the legislation in force at any time governing its collection, processing, use, disclosure, storage and privacy, in accordance with its Privacy and Protection of Personal Data Policy. 5. (Links) - 5.1. BIBAWO Medical A/S is not responsible for the legality, trustworthiness or quality of any content available on a web page to which a link, available on its webshop, refers. 5.2. The availability of links on the website in no way results in the existence of any relationship between BIBAWO Medical A/S and the owner or manager of the web page to which the link refers, nor does it imply the consent of BIBAWO Medical A/S to any materials, content or software made available there.

6. (Cookies) - 6.1. When you visit this webshop, your online device will automatically receive one or more cookies, which are transferred from this webshop to your internet browser. 6.2. A cookie is a small text file. It does not contain any personal information and cannot collect information. 6.3. BIBAWO Medical A/S uses cookies to improve the webshop and your experience. 6.4. If you wish to restrict or block the cookies set up by this webshop, or indeed by any other website, you can do this through your browser settings. 7. (Forum) - 7.1. These Terms and Conditions of Use shall be governed by Danish law. 7.2. The parties have agreed to bring any dispute arising from their interpretation or application before the City Court of Copenhagen, with the express waiver of any other.

8. (Use) - 8.1. The use of the webshop may be made only by the Authenticated User that is granted access to the reserved area for product and services purchasing. 8.2. The authentication consists of the identification of the User, through the introduction of a User ID and password, and the filling in of mandatory fields when registering as an Authenticated User. 8.3. The password chosen by the User is personal and non-transferable, thus prohibiting its transfer or communication to any unauthorized third party. 8.4. Whenever the Authenticated User becomes aware that his/her user data is being used by a third party, he/she shall immediately notify BIBAWO Medical A/S via info@hydrozid.eu. 8.5. Notwithstanding the Privacy and Protection of Personal Data Policy and these Terms and Conditions, BIBAWO Medical A/S may, for security reasons and to safeguard the privacy of communications, restrict or limit the access by Authenticated Use.

9. (Terms of sale) – 9.1. Orders are placed via the webpage shop.hydrozid.eu. Orders may only be placed by healthcare professionals and require a business registration number and/or VAT number. First, the user must create a profile. However, before ordering, the profile and the information provided, included but not limited to the business registration number or VAT number, will be validated. Validation can take up to twenty-four (24) business hours. Upon validation, the user can authenticate himself/herself by introducing the User ID and password and placing an order. 9.2. BIBAWO Medical A/S uses third-party warehousing and carrier services. The items are covered by BIBAWO Medical A/S cargo insurance policy. The package is delivered to the delivery address provided by the customer when placing an order. If there is no one at the address to receive the package, a note will be left at the address informing where the package can be picked up. After placing an order, the customer will receive a track and trace number via email. The delivery is free of charge and the estimated delivery time is 1-3 weekdays. Consignments are only delivered to addresses located in Denmark, Sweden, Iceland or the Faroe Islands. For deliveries to other territories, please contact info@hydrozid.eu. 9.3. BIBAWO Medical A/S warrants that at the time of delivery, the products are free from defects and meet the product specifications. For breach of warranty, the purchase price will be refunded, the defect will be corrected, or the product will be replaced, depending on the specific situation. Warranties are excluded (i) if the damage or fault is caused by improper or unauthorized use, intervention or treatment, natural wear and tear, defective maintenance; (ii) if any modifications or repairs are done by the user; and (iii) if the product is not used as intended or in violation of the instructions provided by BIBAWO Medical A/S. 9.4. BIBAWO Medical A/S only sells products to healthcare professionals (B2B). An Authenticated User may cancel any order before it is processed and forwarded to the third-party warehouse. An Authenticated User does not have the right to cancel the purchase order once it has been processed. Unprocessed orders can be cancelled by sending an email to info@hydrozid.eu. Order number and contact details must be included. 9.5. Complaints are to be reported to BIBAWO Medical A/S via email to info@hydrozid.eu, including a description of the complaint, batch number and preferably a picture or video, if possible. If an item has to be returned, either BIBAWO Medical A/S will pick it up at the delivery address or the customer will be given appropriate guidance, so the affected items are securely packed and sent. 9.6. Prices are quoted in the local currency. The payment options available are VISA, Mastercard, Invoice, MobilePay. Card information and payments are processed by NETS, and the data is protected according to GDPR.
